1. Definitions
In these Terms and Conditions, the following words carry the meanings set out below:
- "Nestpath", "we", "us", "our" — Nestpath, registered at 204 Rama IV Road, Silom, Bang Rak, Bangkok 10500, Thailand.
- "User", "you" — any individual accessing this website or registering for a Nestpath programme.
- "Programmes" — the Document Organisation Workshop, Personal Records Toolkit, and Information & Orientation Programme offered by Nestpath.
- "Website" — the Nestpath website accessible at https://nestpath.biz.
- "Agreement" — these Terms and Conditions, together with our Privacy Policy and Cookie Policy.
2. Acceptance of Terms
By accessing this website or registering for a Nestpath programme, you confirm that you are aged 18 or over, that you have legal capacity to enter into this Agreement, and that you accept these Terms and Conditions in full.
If you do not accept these terms, please do not use this website or register for our programmes.
3. Nature of Our Services
Nestpath provides educational and administrative services relating to retirement document organisation. Our programmes are informational in nature and are designed to assist individuals in gathering, labelling, and filing personal paperwork.
Nestpath does not provide financial advice, legal advice, tax advice, or any form of regulated professional service. Nothing communicated during a session, in written materials, or through this website constitutes a professional recommendation or should be relied upon as such. Participants with questions requiring professional judgement are encouraged to consult a qualified adviser separately.
Programmes are offered primarily in Bangkok, Thailand, and are conducted in English. Nestpath reserves the right to decline a registration where a participant's needs fall outside the scope of our programmes.
4. Registration and Bookings
Registrations for workshops and programmes are accepted by email confirmation from Nestpath. A registration is not confirmed until you have received written confirmation and, where applicable, completed payment.
You are responsible for ensuring that the information provided during registration is accurate. Nestpath may contact you at the email address provided to confirm session details or to provide preparation notes.
5. User Responsibilities
When using this website or attending a Nestpath programme, you agree to:
- Treat other participants and facilitators with courtesy and respect
- Not record or photograph sessions without prior written consent from Nestpath
- Not distribute or reproduce Nestpath materials without written permission
- Not misuse this website or attempt to disrupt its operation
- Provide accurate information when making an enquiry or registration
6. Intellectual Property
All content on this website and all materials provided during Nestpath programmes — including session guides, checklists, explainer cards, and written notes — remain the intellectual property of Nestpath unless otherwise stated.
Materials are provided for personal, non-commercial use by the participant only. Reproduction, redistribution, or adaptation of any Nestpath materials for any other purpose requires prior written consent from Nestpath.
7. Payment Terms
All prices are stated in Thai Baht (฿) and are inclusive of applicable taxes unless otherwise stated. Payment is due at the time of booking confirmation, unless alternative arrangements have been agreed in writing.
Cancellation and refunds: Cancellations made at least 7 days before a scheduled session will receive a full refund. Cancellations made between 3 and 6 days before the session will receive a 50% refund. Cancellations made within 2 days of the session are not eligible for a refund, though participants may transfer their booking to a future session where space permits. The Personal Records Toolkit is non-refundable once dispatched.
Nestpath reserves the right to cancel or reschedule a session. In such cases, a full refund will be provided or an alternative date offered.
8. Session-Specific Terms
Participants attending a Document Organisation Workshop or Information & Orientation Programme are advised to bring any retirement-related documents they wish to organise during the session. Nestpath does not retain or copy documents brought by participants, and does not accept responsibility for loss or damage to documents brought to a session.
Completion of a programme does not result in a certificate, qualification, or any form of professional accreditation. These are informational and organisational services only.
9. Disclaimers
This website and all Nestpath programmes are provided for informational and organisational purposes only. Nestpath makes no representations as to the completeness or accuracy of information provided in sessions or materials, and no warranty is given that any particular outcome will result from attending a programme or using a toolkit.
Nothing on this website or in any Nestpath session is intended as advice on an individual's financial situation, entitlements, legal position, or tax obligations. Participants must not treat any information received from Nestpath as a substitute for advice from a qualified professional.
10. Limitation of Liability
To the maximum extent permitted by Thai law, Nestpath's total liability to you for any claim arising out of or in connection with these terms, our website, or our programmes shall not exceed the amount paid by you for the programme or product in question.
Nestpath shall not be liable for any indirect, consequential, or incidental loss, or for any decisions made by you based on information received through our programmes or website. This includes, without limitation, any financial decisions, dealings with pension providers, or engagements with professional advisers.
11. Indemnification
You agree to indemnify Nestpath, its staff, and its facilitators against any claim, loss, or expense arising from your breach of these terms, your conduct at a session, or any misuse of materials or information provided by Nestpath.
12. Termination
Nestpath reserves the right to refuse access to any session or to remove a participant from a session where their conduct is disruptive, disrespectful to others, or in breach of these terms. In such circumstances, a refund will be considered on a case-by-case basis.
Either party may terminate a pending booking by giving written notice. Sections 6, 9, 10, and 11 of these terms survive termination.
13. Governing Law and Disputes
These Terms and Conditions are governed by the laws of Thailand. Any dispute arising from or related to these terms shall first be referred to informal resolution by contacting Nestpath at [email protected].
If a dispute cannot be resolved informally within 30 days, it shall be subject to the jurisdiction of the courts of Bangkok, Thailand.
14. General Provisions
These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Nestpath in respect of your use of this website and our programmes. If any provision is found to be unenforceable, the remaining provisions shall continue in full effect.
Nestpath's failure to enforce any right under these terms shall not constitute a waiver of that right. You may not assign any rights or obligations under this agreement without Nestpath's written consent.
15. Changes to These Terms
Nestpath may update these terms from time to time. Any changes will be published on this page with a revised date. Continued use of our website or registration for a programme after changes are posted constitutes acceptance of the updated terms.
